Adventure Waiver & Release

Our adventures are designed to be fun and self-guided. Before participating, please review the important safety information and participant responsibilities below.

1. Acknowledgment of Risks

By participating in a Leavenworth Unlocked adventure, you acknowledge that these experiences involve walking through public areas, interacting with local businesses, crossing streets, navigating sidewalks, and making your own decisions throughout the adventure.
Participation may involve risks including, but not limited to, slips, trips, falls, uneven pavement, weather conditions, traffic, construction, interactions with other pedestrians or vehicles, and other hazards commonly associated with being in public places.
You voluntarily choose to participate and understand that you are responsible for exercising good judgment, following all laws, obeying traffic signals, respecting private property, and acting safely at all times.

2. Health & Participation

Participants should only take part if they are physically and mentally able to do so safely.
Each participant is responsible for determining whether the adventure is appropriate for their own abilities and those of any children or guests accompanying them.
If at any time you feel unsafe, uncomfortable, or encounter hazardous conditions, you should discontinue the activity immediately.
Leavenworth Unlocked is not responsible for monitoring participants during an adventure.

3. Release of Liability

To the fullest extent permitted under Washington law, you agree to release, waive, and hold harmless Leavenworth Unlocked LLC, its owners, employees, contractors, volunteers, partners, sponsors, and participating businesses from any claims, demands, damages, losses, injuries, expenses, or liabilities arising from or related to your participation in any Leavenworth Unlocked adventure.
This release applies regardless of whether participation occurs before, during, or after completing an adventure.
Nothing in this waiver limits rights that cannot legally be waived under applicable law.

4. Indemnification

You agree to be responsible for your own actions during the adventure.
If your conduct causes damage to property, injury to another person, or results in claims against Leavenworth Unlocked arising from your actions, you agree to indemnify and hold Leavenworth Unlocked harmless from those claims to the extent permitted by law.
Participants are expected to treat local businesses, public spaces, and fellow visitors with courtesy and respect throughout the adventure.

5. Photography & Media

Many adventure challenges encourage participants to take photographs or videos.
By submitting photographs, videos, or other content through Leavenworth Unlocked, you confirm that you own the content or have permission to share it.
If you voluntarily opt in to allow Leavenworth Unlocked to use your submitted content for promotional purposes, you grant Leavenworth Unlocked a non-exclusive, royalty-free license to display that content on its website, social media channels, or marketing materials.
Participation does not require granting this permission, and your decision will not affect your ability to enjoy the adventure.

6. Governing Law & Jurisdiction

These Terms and this Adventure Waiver are governed by the laws of the State of Washington, without regard to its conflict of law principles.
Any dispute arising from your participation in a Leavenworth Unlocked adventure shall be brought in the state or federal courts located in Washington State, and you consent to the jurisdiction of those courts.
If any provision of this Waiver is determined to be unenforceable, the remaining provisions shall continue in full force and effect.

7. Participant Responsibilities

Participants agree to:

Follow all federal, state, and local laws.
Obey traffic signals and cross streets safely.
Respect private property and participating businesses.
Follow any instructions provided by participating businesses.
Avoid entering restricted or unsafe areas.
Refrain from any behavior that could endanger themselves or others.
Remember that Leavenworth Unlocked is designed to be a self-guided experience and that each participant is responsible for their own decisions throughout the adventure.
